The Point System

The NYS Department of Motor Vehicles (DMV) uses the Point System to determine if your driving privileges will be suspended or revoked and if you have to pay a penalty for having too many points. Points are charged against a driver’s license when DMV is notified of the following convictions :

SPEEDING
1-10 mph over the limit 3 Points
11-20 mph over the limit 4 Points
21-30 mph over the limit 6 Points
31-40 mph over the limit 8 Points
41 or more mph over the limit 11 Points

LIGHTS & SIGNS
Passing Red Light 3 Points
Passing Stop Sign 3 Points
Failure To Yield Right Of Way 3 Points
Crossing Hazardous Markings 3 Points
Disobeyed A Traffic Control Device 2 Points

OTHER COMMON VIOLATIONS
No Seatbelt for person under 16 3 Points
Improper Passing 3 Points
Unsafe Lane Change 3 Points
Tailgating/Following Too Closely 4 Points
Passing Stopped School Bus 5 Points
Reckless Driving

5 Points/
Criminal Offense

Leaving an Accident Scene with Property Damage 3 Points

DRIVER RESPONSIBILITY ASSESSMENT
DMV Penalty For Points

If a driver is convicted of 6 Points, the Department of Motor Vehicles will impose a penalty of $100. per year and $25. for each additional Point, per year, for a total of 3 years. If the driver fails to pay the penalty for each year, the driver’s license will be suspended. (Note : This penalty only applies if you accumulate 6 or more Points within an 18 month period for tickets issued on or after November 18, 2004.)
